2. PRIZE: 

Each night the first caller with the correct answer wins a $50 gas credit  card.

3. ELIGIBILITY: 

Contestants must be at least 18 years of age, residents of Alabama with a Social Security number and a government issued photo ID.  No employee of CBS 8, Bahakel Communications, LTD., their affiliated companies, his or her spouse, or immediate family members and/or those living in the same household of each shall be eligible to win.  Immediate family members include, but are not necessarily limited to, parents, brothers, sisters, nieces, nephews, aunts, uncles, cousins, and grandparents.  Additionally, the Station reserves the right to disqualify any other person from participation in the Contest where such participation would, in the sole opinion of the Station, compromise or give the appearance of compromising the integrity of the Contest.  No person shall be eligible to win any contest conducted by the Station more than one time in any sixty-day period.  Limit one "SMART Contest" winner per household. All winners must sign a Winner's Affidavit & Release and an IRS W-9 form.

 4. MISCELLANEOUS:
 
   (a) Station is not responsible for any failed telephone transmission, including but not limited to  
         misdirected, incorrectly dialed or disconnected phone calls, overloaded circuits, failure of any
         electronic or phone equipment, inability to complete a call due to busy signals or limitations   
         of any local or national telephone service provider or system.

    (b) Station accepts no responsibility or liability for loss or damage due, in whole or in part, to the
          awarding, acceptance, possession, use or misuse of any prize or from participation in the
          Contest. Contestants in conjunction with the acceptance of  any prize in the Contest agree to
          hold Station, Bahakel Communications, LTD, and their affiliated companies, employees and
          sponsors harmless from, any injuries, losses or damages, of any kind caused by or resulting
          from acceptance, possession or use of any prize awarded hereunder.

     (c) All winners must sign a release/waiver that releases Station and affiliated companies and
          employees any and all liability, claims, demands or action resulting from use of the prizes
          awarded. Station is not responsible for any typographical or other error in the promotion of
          the Contest, administration of the Contest or in the announcement of the prizes.

     (d) Contestant's failure to sign Winner's Affidavit & Release, an IRS W-9 form and to present
           Station their Social Security card and a government-issued photo ID will result in the
           forfeiture of prizes.

     (e) By participating, Contestants consent to the Station's use of their name, likeness and or
           voice without further compensation for advertising, public relations and promotional
           purposes.

      (f) All prizes are non-transferable and non-assignable. Station's decision with regard to all
          matters relating to the Contest, including those matters not specifically addressed in these
          rules, shall be final.  Prizes not claimed in accordance with these rules will be forfeited and
          will not be awarded.
